1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and IntechPay regarding your use of our payment processing platform and related services (collectively, the “Services”).

By registering for, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age or the age of legal majority in your jurisdiction
  • Have the legal capacity to enter into binding contracts
  • Operate a legitimate business or organization
  • Not be prohibited from using the Services under applicable laws
  • Provide accurate and complete registration information

3. Account Registration and Security

When you create an account with IntechPay, you agree to:

  • Provide truthful, accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized access or security breach
  • Accept responsibility for all activities that occur under your account

4. Payment Processing Services

4.1 Service Description

IntechPay provides payment processing services that enable you to accept payments from customers through various payment methods including credit cards, debit cards, mobile wallets, and alternative payment methods.

4.2 Fees and Charges

You agree to pay all applicable fees for the Services as outlined in your pricing agreement. Fees may include transaction fees, monthly fees, chargeback fees, and other charges. We reserve the right to modify fees with reasonable notice.

4.3 Settlement and Payouts

Funds from processed transactions will be settled to your designated bank account according to your settlement schedule. We may hold, delay, or suspend payouts if we suspect fraud, violations of these Terms, or for risk management purposes.

5. Prohibited Activities

You may not use the Services to:

  • Process payments for illegal goods or services
  • Engage in fraudulent or deceptive practices
  • Violate any applicable laws, regulations, or third-party rights
  • Process payments without proper authorization from cardholders
  • Engage in money laundering or terrorist financing
  • Sell counterfeit or stolen goods
  • Process excessively high-risk or prohibited transactions

6. Chargebacks and Disputes

You are responsible for handling customer disputes and chargebacks. When a chargeback occurs:

  • We will notify you and provide relevant information
  • You may submit evidence to dispute the chargeback
  • Chargeback fees will apply as specified in your pricing agreement
  • Excessive chargebacks may result in account suspension or termination

7. Compliance and Regulations

You agree to comply with all applicable laws and regulations, including but not limited to payment card industry standards (PCI DSS), anti-money laundering laws, and consumer protection regulations. You are responsible for obtaining and maintaining all necessary licenses and permits for your business operations.

8. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, and software, are owned by IntechPay and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by law, IntechPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

10. Termination

Either party may terminate this agreement with written notice. We may suspend or terminate your account immediately if:

  • You breach these Terms
  • We are required to do so by law
  • Your use of the Services poses a risk to us or others
  • Your account remains inactive for an extended period
