By using IntechPay services, you agree to comply with this AUP. Violation of this policy may result in immediate suspension or termination of your account, withholding of funds, and reporting to relevant authorities.
2. Prohibited Activities
You may not use IntechPay services to engage in or facilitate the following activities:
2.1 Illegal Activities
- Any activity that violates applicable laws, regulations, or ordinances
- Sale or distribution of illegal drugs, substances, or paraphernalia
- Money laundering or terrorist financing
- Theft, fraud, or any other criminal activity
- Violation of intellectual property rights or trade secrets
2.2 Fraudulent or Deceptive Practices
- Processing fraudulent or unauthorized transactions
- False advertising or misrepresentation of products or services
- Pyramid or Ponzi schemes
- Credit repair schemes or debt collection scams
- Get-rich-quick schemes or investment fraud
- Identity theft or impersonation
2.3 High-Risk Financial Activities
- Unlicensed money transmission or currency exchange
- Sale of unregistered securities or investment contracts
- Cryptocurrency mining services (without prior approval)
- Timeshare resale services
- Debt collection or debt reduction services without proper licensing
2.4 Prohibited Goods and Services
- Weapons, firearms, explosives, or ammunition (without proper licensing)
- Counterfeit or stolen goods
- Adult content or services (pornography, escort services)
- Gambling or betting services in restricted jurisdictions
- Tobacco products in certain jurisdictions
- Endangered species or protected wildlife products
- Human trafficking or exploitation services
2.5 Harmful Technical Activities
- Hacking, phishing, or distribution of malware
- Unauthorized access to systems or networks
- Denial-of-service attacks or similar disruptions
- Spam or unsolicited commercial communications
- Circumventing security measures or authentication systems
3. Restricted Activities Requiring Prior Approval
The following activities may be permitted with prior written approval from IntechPay:
- Cryptocurrency exchanges and related services
- Online gaming or skill-based competitions
- Telemarketing or outbound sales services
- High-value luxury goods and jewelry
- Age-restricted products in specific jurisdictions
- Nutraceuticals and dietary supplements
- Travel aggregation or reservation services
4. Transaction Requirements
All transactions processed through IntechPay must:
- Be authorized by the legitimate cardholder or account owner
- Accurately describe the goods or services being purchased
- Include clear terms and conditions, including refund policies
- Provide receipts and transaction confirmation to customers
- Honor refund and cancellation requests in accordance with your policies
- Maintain adequate records of transactions for at least 3 years
5. Chargeback Management
To minimize chargebacks and disputes, you must:
- Provide excellent customer service and respond promptly to inquiries
- Use clear and recognizable billing descriptors
- Deliver products and services as described
- Obtain proof of delivery for physical goods
- Implement fraud prevention measures
- Respond to chargeback notifications within required timeframes
Note: Excessive chargebacks (typically above 1% of transactions) may result in additional fees, account restrictions, or termination.
6. Customer Data Protection
You must protect customer payment information and personal data:
- Never store complete payment card numbers, CVV codes, or PINs
- Use IntechPay’s secure payment forms or tokenization services
- Maintain PCI DSS compliance for your environment
- Implement appropriate data security measures
- Report any data breaches immediately to IntechPay
- Obtain proper consent for data collection and processing
7. Marketing and Communications
When marketing your products or services:
- Do not make false or misleading claims
- Comply with advertising laws and regulations
- Honor opt-out requests from marketing communications
- Clearly disclose all terms, fees, and conditions
- Do not use deceptive practices to obtain payment information
8. Monitoring and Enforcement
IntechPay reserves the right to:
- Monitor transactions for compliance with this AUP
- Investigate suspected violations
- Request additional information about your business or transactions
- Suspend or terminate accounts that violate this policy
- Hold funds pending investigation of suspicious activity
- Report violations to law enforcement or regulatory authorities
- Cooperate with legal investigations
9. Consequences of Violations
Violations of this AUP may result in:
- Warning and requirement to cease prohibited activities
- Temporary suspension of payment processing services
- Immediate termination of your account
- Withholding of funds to cover potential liabilities
- Additional fees or penalties
- Legal action to recover damages
- Reporting to law enforcement, regulatory agencies, or payment networks
- Inclusion on industry watchlists or databases
10. Reporting Violations
